On April 2, 2009 at approximately 12:45 a.m., the defendant (Gonzalez-Puc) approached the victim on the victim’s property and asked him for a beer.  When the victim refused, he bumped the suspect with his chest and walked inside of a storage room of the machine shop on the property.  The suspect then obtained a large hand held hammer that was located in a storage bin and followed the victim.  While both parties were located in the confines of the storage area, the suspect struck the victim in the head numerous times with the hammer.  The suspect then fled the scene and was located by deputies and taken into custody charged with attempted murder.  The victim was transported to Tampa General Hospital.

 

On April 4, 2009, the victim (Robert Lemagnes) died as a result of his injuries.

Charges were upgraded from Attempted Murder to 2nd Degree Murder.
